Wills, Powers of Attorney and Advanced Trust Planning
Regardless of your asset base, you should have the essential estate planning documents to guide loved ones in the event of your incapacity or death:
- A simple will naming heirs and what they will inherit
- Power of attorney for financial affairs
- Power of attorney for health care ("living will")
- Designated guardianship for minor children
Our lawyers also construct complex trusts tailored to your goals for building wealth, bypassing probate, minimizing inheritance taxes, asset protection, business succession, charitable giving or controlling how your children will inherit:
- Charitable lead or charitable remainder trusts
- Grantor-retained annuity trusts
- Dynasty trusts (generation-skipping trusts)
We can customize your estate plan for the unique issues that arise with inheritance in blended families, pre-marital or co-habitation agreements, grandparents caring for their children's children and other family scenarios.
Special Needs Planning
Lisa Line brings extensive familiarity with special needs trusts:
- Third-party trusts established by the parents of adult disabled child — Placing assets in trust preserves your child's eligibility for Medicaid and Social Security, while providing money for extraordinary needs such as transportation not covered by those programs.
- Self-settled (first party) special needs trusts — Persons under age 65 can protect certain assets such as a personal injury settlement, inheritance or lottery winnings to retain Medicaid and SSI eligibility. The trust funds offer supplemental income to the beneficiary while living, repaid to Medicaid under state law.
Estate Administration
If you are named in the will or appointed by a judge to settle a family member's estate, Ms. Line and Mr. Demman can guide you through all duties: opening the estate, gathering assets, paying debts, liquidating assets, distributions to heirs and filing of taxes and accounting statements.
Probate Litigation
Lisa Line and Jason Demman represent the estate or excluded heirs in will contests alleging fraud or undue influence, or challenging the testamentary capacity of the deceased at the time the last will was drawn. She also represents the estate or an executor or trustee in litigation over breach of fiduciary duty (e.g., misappropriation of assets).
Your needs are unique, and we can help you plan accordingly. You can reach us at 402-397-2000 or 1-800-768-1469 to arrange your initial consultation, including evening or weekend appointments.
